Lighter sentence for man who assaulted partner

A Queanbeyan man convicted of assaulting his partner after their relationship ended has successfully appealed against the sentence he received in the ACT Magistrates Court.

Last January the man was driving along Canberra Avenue when he swerved his car towards his former partner's car, making her afraid she would crash.

He was sentenced to nine months' jail with six months non-parole in October.

He appealed to the ACT Supreme Court arguing the magistrate had not placed enough weight on his mental condition.

ACT Supreme Court Justice Richard Refshauge upheld the appeal, finding the sentencing magistrate was somewhat dismissive of a psychiatric report which lacked detail, but said the man suffered from chronic anxiety and major depression.

Justice Refshauge's confirmed the conviction, resentencing the man to nine months in prison to be served by periodic detention, and a good behaviour order, so he can receive psychiatric treatment.
