Lexington city council member arrested at AT&T store

A Lexington city council member faces multiple charges after police say they responded to a disorder at an A-T and T store Sunday. Lexington police say they arrested Tayna Fogle a little after 3 p.m. and charged her with 3rd degree criminal trespassing, menacing and resisting arrest. Her attorney, Daniel Whitley senior, said she was overcharged. 

“She's been a strong critic against the Lexington Police Department. So I anticipate the police, having the discretion to charge her, added additional charges so they have a basis to arrest her, to publicly embarrass her, versus citing her for the criminal trespass and letting her go home.”

Whitley said police had no reason to take her to jail.

“That's an agenda they want to do, because in this situation, she doesn't have a flight risk or a danger to the community where she can't be cited and sent home. So I think that they added the additional charges to add that level of humiliation.”

Lexington police did not immediately respond to a request for comment. Fogle will be arraigned Friday afternoon in Fayette District Court.
