LeBron James trademark application for ‘Taco Tuesday’ is refused

In a decision that is shocking to approximately four people, the United States Patent and Trademark decided that LeBron James’ application to trademark the phrase “Taco Tuesday” wasn’t legitimate enough to win.

Darren Rovell of The Action Network tweeted about the news that the phrase was determined to be a “commonplace message,” and therefor could not be protected by trademark protections. Every bar in America would have answered the take that “Taco Tuesday” is a common place message but no LeBron has further authority on how widely used the phrase is.

James’ “Taco Tuesday” videos have become a viral phenomenon this summer, increasing with his full-time move to the Los Angeles area. And while the content was entertaining for many, it was far from a unique concept. Nevertheless, LeBron and his variety of media outlets could create all of the formal “Taco Tuesday” content they want on social media and on the internet in general. Just because they don’t technically own the concept doesn’t mean there isn’t a way for them to turn a profit on LeBron’s Taco Tuesday following.
