Lanarkshire crook jailed after refusing to do community payback over COVID fears

An offender refused to do community work at an old folks' centre because he was afraid of catching COVID.

Robert Allan has now been sent to prison for breaching the court order.

The unpaid work order was imposed at Airdrie Sheriff Court last year as an alternative to a jail sentence.

Allan had admitted threatening or abusive behaviour involving his partner at his home in Kirkwall, Cumbernauld, in July 2019.

Allan, 46, returned to court this week and admitted a breach of the community payback order by failing to attend for work.

Asked why he hadn't done more hours, he told Sheriff Petra Collins: "My placement was in an old folks' complex.

"My partner didn't want me to take the risk of catching COVID there and bringing it back to the house."

Allan, who represented himself in court, conceded that he hadn't shared his partner's concerns with his supervising officer.

Sheriff Collins jailed him for four months, saying: "I'm sorry, but you have been given every opportunity by the court.

"This is the second time you have breached the order and you didn't stay in touch with your supervising officer.

"The order was imposed a long time ago and you have made no progress whatsoever."
