Kirsty Maxwell’s family blast lawyer's claim probe into balcony fall death was 'excessive'

family have reacted angrily to a lawyer’s claims that the investigation into her death was “excessive”.

Robert Sanchez, who represented the five men cleared over her fatal balcony fall, said the 30-month probe distressed his clients.

Sanchez said: “This investigation has gone on and on, and from my point of view has been excessive.

“What I can say for certain is that my clients didn’t have anything to do with the fact that this woman plunged to her death.

“They have also suffered a lot over the last two-and-a-half years.”

His comments came after a Spanish judge ruled that Kirsty’s 10th floor plunge while on a hen night in Benidorm in April 2017 was an accident.

The 27-year-old, from Livingston, had mistakenly entered an apartment, occupied by Daniel Bailey, Ricky Gammon, Joseph Graham, Anthony Holehouse and Callum Northridge, thinking it was a friend’s room.

The men, from Nottinghamshire, denied any involvement in Kirsty’s death.

Judge Ana Isabel Garcia-Galbis decided there was no evidence connecting them to the incident.

Kirsty’s family and private detective David Swindle, a former senior Strathclyde Police officer who has been helping them, were furious at Sanchez’s comments.

He said: “It shouldn’t matter how long it takes to investigate a death and to get to the truth.

“We aren’t satisfied that all lines of inquiry have been exhausted.”

Kirsty’s parents Brian and Denise Curry and her husband Adam Maxwell are expected to appeal.

They previously described the circumstances of her death as “sinister and suspicious.”
