Kath Elliott wins stay of proceedings against ban

Newcastle Independents councillor Kath Elliott.

Newcastle councillor Kath Elliott can resume her civic duties after the NSW Civil and Administrative Tribunal granted her a stay of proceedings pending her appeal against suspension.

The Office of Local Government suspended Cr Elliott for six weeks from mid-October for leaking a confidential investigation report into one of her own code-of-conduct breaches.

The suspension now will not take effect until her appeal is heard.

Cr Elliott is seeking re-election on December 4 as part of the Newcastle Independents alliance.

OLG coordinator general Kiersten Fishburn found last month that Cr Elliott had provided to the media confidential details of at least 12 code-of-conduct complaints about herself, excerpts of transcripts of interviews of identified individuals, her own submissions in relation to a number of conduct complaints and information that identified complainants.

The Newcastle Herald reported last year that an external workplace consultant had found Cr Elliott committed a "serious breach" in verbally abusing chief executive officer Jeremy Bath during a council workshop.

Mr Bath told investigators Cr Elliott's verbal spray was "one of the most spectacular dressing downs I've ever received in my corporate life".
