Judge: Walgreen can keep inside information out of defamation trial

Dec. 04--Walgreen's request for a protective order to limit public disclosure of proprietary information during litigation with the company's former chief financial officer was approved by a Cook County judge Thursday morning.

In making the request, Walgreen had said the order was necessary to keep private additional information about its finances, business strategies, transactions and trade secrets.

The lawsuit, filed in October by ex-CFO Wade Miquelon, included paragraphs and exhibits that the judge agreed to redact last month because they revealed confidential information. The suit also included internal emails between executives that gave a rare peek into discussions about an upcoming earnings report and deal.

Miquelon claims that Walgreen defamed him when subsequent news reports suggested he was personally responsible for a $1 billion forecasting error. The lawsuit claims that Walgreen's characterizations of Miquelon torpedoed his efforts to find a new job.

Associate Judge Franklin Valderrama will rule on a motion to dismiss the case Dec. 19. Miquelon has until Dec. 22 to sign a final release to collect a $3.2 million severance package and $1.2 million bonus.
