Jail for robber who stabbed victim in his home and went through his pockets

A thug who stabbed a man and robbed him of cash has been jailed for two years.

The victim was attacked in his East Kilbride home, Hamilton Sheriff Court heard on Friday.

Gary Rooney, 44, a prisoner, admitted assaulting and robbing Donald Cusack in Stratford, Calderwood, on August 14 last year.

Co-accused Danielle Egan, 30, of Larch Drive, East Kilbride, had her not guilty plea accepted.

The court heard that Mr Cusack, who suffered a stomach wound, has since passed away, but his death was not linked to the assault.

Mairi-Clare McMillan, prosecuting, said he and another person lived at the house.

She told the court: "They heard a noise at the door and the accused entered the living room.

"He was shouting and swearing, stating 'Get your money out'.

"Rooney was holding a kitchen knife and threatened Mr Cusack with violence if he did not hand over his money.

"He then stabbed Mr Cusack on the stomach and went through his pockets, removing approximately £100.

"Neighbours heard the disturbance and someone shouting 'Where is it? Where is it?'

"The accused was seen walking away from the house."

Mr Cusack was taken to hospital for treatment to a 1.5cm stomach wound. He was detained overnight for observation.

Defence agent Jackson Bateman stressed it was a matter of agreement that Rooney had not gone armed to the house, but had taken the knife from a table there.

He claimed that Mr Cusack had been supplying drugs to Danielle Egan.

Mr Bateman stated: "Gary Rooney wanted him to stop doing that and there was animosity between them.

"He turned up with Egan at the house to confront Mr Cusack.

"Unfortunately, matters went too far. He accepts he dealt with things in an inappropriate way.

"Thankfully, there was no danger to life and no significant medical intervention was required."

Mr Bateman said Rooney had kept out of trouble for a period before this and had been trying to "turn his life around".

He had gained employment in a warehouse.

Sheriff Douglas Brown told Rooney: "A significant sentence must be imposed given the potential for a knife to cause very serious injury."

The two-year prison stretch was backdated to August 17 as the accused has been in custody since his arrest.
