A MAN who supplied a 15-year-old schoolgirl with MDMA and alcohol before choking her unconscious and raping her in his car under the Stockton bridge has been jailed for a maximum of more than six years in Newcastle District Court.
Mitchell Dean Leslie, now 23, was found guilty in April this year of three counts of aggravated sexual assault, supplying a prohibited drug and intentionally choking after a judge-alone trial.
Leslie and the victim met a number of times in early 2019 and she told him she was 15, Acting Judge Stephen Walmsley said on Friday.
In June he picked her up from a service station and she told him she wanted to "get wasted" so he drove her to a location under the Stockton bridge and gave her a bottle of rum to drink from.
Leslie also supplied her with an MDMA tablet and she transferred him $20 for the drug.
About half-an-hour later she was intoxicated and Leslie asked her to have sex with him, to which she replied: "no, it's not going to happen".
"At this point she was so intoxicated she was unable to move her head or body," Acting Judge Walmsley said.
Leslie then repeatedly sexually assaulted the girl and choked her until she lost consciousness.
Later, during the drive home, Leslie threatened to hurt the girl if she told anyone what had happened.
Acting Judge Walmsley jailed Leslie for a maximum of six years and six months, with a non-parole period of four years.
He will be eligible for parole in 2025.
