'Intrusive' Rathmines LED billboard ruled compliant by Dublin City Council

An "intrusive" LED billboard has been ruled compliant with planning regulations by Dublin City Council.

The bright electronic billboard sparked a controversy when it was installed just a few metres from a bedroom window in Rathmines. The local authority's planning enforcement department carried out a "thorough investigation" into the issue after a number of complaints were lodged.

The brightness level and fade and transition, which were the focus of the complaints, were found to "now" be in compliance with the requirements. The brightness of the electronic billboard which runs advertisements is understood to have been turned down.

There is also a fade in and out feature which means there isn't as much flashing between colours when the advertisement changes every ten seconds. In a letter to the Manager of the South East Area, acting Planning Enforcement Manager Joe Ryan said the billboard is planning compliant but added the decision would be held in "abeyance" for three months.

He said: "We wish to advise you that a thorough investigation has been carried out, with respect to the allegation of non-compliance with conditions 2 and 3 attached to the approved planning decision order ref: AB-312608-22, and found both the fade transition and the luminance measurements to be now in compliance with the requirements set out within said conditions of permission.

"However given the nature of the complaint received, a decision has been made to hold this file in abeyance for a period of 3 months to ensure continued compliance with the permission granted."

Diana O'Dwyer, who is lives in the flat just a few metres from the billboard, told Dublin Live it is still "intrusive" and wants it to be removed or the brightness lowered further.

She told Dublin Live: "They changed it to a fade transition. It is not flashing in the same way anymore but it is still changing colour every 10 seconds.

"It is fading in and out rather than flashing and it is still way too bright. It is just a couple of metres outside our window so we still have to have black out blinds up all the time and it still doesn't fully block it out at night time.

"It is still a really bad problem as far as we are concerned."

"It is still really intrusive and much too bright - during the day and night. We still want it completely removed or turned down to such a level that it is not intrusive on our lives."

Independent Councillor said: "It is not good enough that they gave us a note to say they conducted an enquiry into this. We need to see the transparency.

"We need to see the process and we need to be satisfied that everything here was to the letter of the law."
