Internet device ban handed to EK sex offender who breached court order

Fears have been raised that an East Kilbride sex offender is “going under the radar” to get internet access.

Restrictions were placed on Christopher Kennedy’s online activities following his conviction for indecent communication with a person he thought was a girl aged 14.

Now he’s been banned from possessing any device capable of internet access.

Kennedy, of Mount Cameron Drive, was trapped by a member of a vigilante group posing as a schoolgirl.

He had inappropriate online chats and asked the decoy to send him pornographic photos.

Kennedy was given a two-year supervision order at Hamilton Sheriff Court in June 2019 as an alternative to custody.

Last year the order was tightened because of concerns regarding his internet use.

Sheriff Alasdair MacFadyen restricted him to one mobile phone, one desktop computer and one laptop computer.

The sheriff warned he must not access the internet with any other device without approval from his social worker.

Kennedy, 32, was back in the dock this week and admitted breaches of the revised order.

It wasn’t stated in court what these breaches were, but Sheriff MacFadyen was sufficiently concerned that he banned Kennedy from having any phone, tablet, laptop or other computer capable of internet access.

The sheriff said: “The supervising officer has concerns regarding your access to the internet. You were doing that under the radar as it were.”

Defence agent Gerry McGuire said his client has only one iphone and that is currently ‘pawned’ and in the care of a Cash Converters store.

Sheriff MacFadyen said if the phone is redeemed it must be delivered immediately to Kennedy’s mother.

Kennedy was ordered to return to court on March 10 for another review of the case.
