FORT LAUDERDALE, Fla. _ Instagram video of an alleged pot party at Kodak Black's Pembroke Pines home _ when a guest held a handgun while an infant was present _ led to the performer's return to jail Thursday, the Broward Sheriff's Office said.
Black, 20, whose real name is Dieuson Octave, did not take the baby away from the group on Saturday when the video was made, the sheriff's office said.
Deputies say one of four guests had a marijuana joint in his mouth and was "inches from the infant's face," while a second man was rolling a joint and a third man was "playing" with a Sig Sauer handgun "in a reckless manner," according to an arrest report that described the video that appeared on social media.
Authorities declined to describe what Black's relationship may be to the child. The sheriff's office declined to release the video, saying it was evidence.
The hip-hop artist was taken into custody after deputies searched his home.
Deputies from the gang investigations unit along with Florida probation and parole officers found nearly 95 grams of cannabis in Octave's bedroom closet. Octave gave investigators the combination to his safe, and inside was cash and a loaded magazine of nine bullets for a Glock handgun. A 9 mm Beretta handgun and ammunition were seized from Octave's office, the arrest report said.
The Beretta had been reported stolen out of Tamarac, deputies said.
Octave was on house arrest and felony probation for robbery and five counts of false imprisonment before his latest arrest, the report said. He was also on felony probation for being a delinquent/felon in possession of a gun and fleeing/eluding police.
While on probation, Octave had been ordered by a court to not have guns or narcotics.
He was arrested Thursday on suspicion of committing child neglect; two counts of possession of a weapon and ammunition by a Florida delinquent; grand theft of a firearm and two counts of violating probation.
During a hearing in Fort Lauderdale Friday, defense attorney Brad Cohen said the firearm was found in a house shared with at least six other adults and the ammunition was found in a safe shared with at least two other adults.
Other people in the house have permits to carry a weapon, according to the lawyer.
The other four men seen in the Instagram video were not arrested, a Broward Sheriff's spokeswoman said.
A sixth man in the house, Octave's brother Masnik Sainmelus, 26, was also arrested Thursday, on suspicion of possessing cannabis, codeine and Alprazoalam, or Xanax.
Sainmelus was also charged on a warrant with driving while his license is suspended or revoked, according to his arrest report. He was freed Friday from a Broward County jail on bonds of $2,350.
Broward Judge Joel Lazarus denied bond for Octave and said he can ask for it at a later date when he appears before his trial judge.
Cohen said he has represented Octave for the past six months.
"He's made great strides," Cohen said after the hearing. "This is of course a setback, but we're going to handle it and we're going to raise the defenses that we need to raise."
Cohen did not know if Octave's latest legal troubles has affected his relationship with his record label or if he will miss any performance dates while he is in jail.
Though increasingly successful in his hip-hop career, the young performer has legal problems out of state, too.
He is accused of sexually assaulting a woman in a hotel room in Florence, S.C. while there to play a show in February 2016.
After his Dec. 1, 2016, release on bond from the Florence County Detention Center, Octave was jailed once in Broward County for violating the terms of his house arrest in a prior, separate case, according to Cohen.
