INDORE: The Indore bench of MP high court on Friday dismissed the bail application of suspended IAS Santosh Verma in a fraud case observing that the applicant counsel was unable to explain as to how the applicant knew about the fact of passing judgement dated October 6, 2020.
“During arguments it was stated that he sought information about passing of the judgement from the internet, but it has come on record that the said judgement of October 6, 2020, was not uploaded on CMIS”, stated the court.
Even after knowing the fact that his case was not fixed for judgement, the applicant applied and obtained a copy of the forged judgement and got it submitted before competent authority for promotion awarding IAS cadre, Justice Satyendra Kumar Singh observed.
Verma through his counsel Abhinav Dhanodkar filed the bail application. Verma was arrested on July 10 for commission of offence punishable under Section 120B, 420, 467, 468, 471, 472 of IPC for conspiracy, cheating, forgery of document, forgery for cheating, fraudulently or dishonestly using a fake document as genuine, making or counterfeiting any seal, plate or other instrument.
The prosecution case is that a case under Section 294, 323 and 506(II) of IPC voluntarily causing hurt, criminal intimidation and circulation of obscene material’ was pending before the court of JMFC, Indore.
The applicant in connivance with another person made a conspiracy and obtained a copy of forged and fabricated judgement dated October 6, 2020 from the copying section of the district court, Indore with an intent to cheat the government and submitted the same before the competent authority and got promotion awarding IAS cadre, stated prosecution story.
"Verma had been falsely implicated in the matter. The applicant only after knowing that the judgement was passed in the criminal case, applied for it and obtained a certified copy from the copying section of the district court," submitted advocate Dhanodkar.
The public prosecutor has specifically stated in his statements that he saw the original judgement dated October 6 in the concerned file, submitted Dhanodkar demanding bail as the trial would take time and chargesheet is submitted.
