Ilkeston man assaulted his wife after bursting into bathroom to catch her on her phone

An abusive thug dragged his wife into her house before throwing her on the ground and punching her.

Daniel Bramley was seen by neighbours as the woman desperately tried to hold onto her door frame before he assaulted her.

The 34-year-old, of Ilkeston, left his car when their son came downstairs to see what was going on, reports DerbyshireLive.

Bramley was then found to be more than twice the drink-drive limit, giving a reading of 77 microgrammes in 100 millilitres of breath. The legal limit is 35.

Southern Derbyshire Magistrates' Court heard this incident, which took place in August, was not the first time Bramley had assaulted his wife.

In February, he split her eye open with a punch when she got out of the bath after previously accusing her of being unfaithful. 

District Judge Andrew Meachin, who presided over the case, handed him a community order for his actions.

Assault after getting out the bath

Sarah Sanderson, prosecuting, told the court the first assault took place in February.

She said: "The victim was in the bath and had her back to the door.

"She was looking at her phone on Facebook and she clicked onto a male's profile.

"The defendant burst into the bathroom and said 'I've caught you'. He had previously accused her of being unfaithful in the relationship."

The court heard how the victim got out of the bath and said "the relationship was over".

He went on to punch her in the right eye, splitting it open and scarring her.

Clinging to the door frame

Ms Sanderson said the second incident took place on August 8.

The victim had been putting her son to bed and saw the defendant's work car outside the property.

She said: "She wasn't aware where he was. She then sees he was lying on the floor in the garden and appeared to be asleep.

"She was going to take a picture of him as she thought he looked 'quite funny'. The defendant got up and looked very angry towards her saying 'who are you talking to, why are you laughing?'.

"The victim tried to get to the car thinking the keys maybe in the car. She moves further down the driveway hoping neighbours see what's happening."

The court heard how neighbours saw her cling to the door frame as he dragged her back into the property.

He pulled her into the property, pushed her on the floor and punched her on the left side of her face.

Ms Sanderson said at this point the young son walked in to see what was happening.

Drink driving

She said: "At this point the defendant stopped what he was doing.

"He took the keys and the car. He didn't drive very far. He gave a reading of 77 microgrammes at the police station.

"He makes admissions to what happened, accepting both assaults and also accepts he was driving whilst over the limit."

Bramley had no defence solicitor in court and addressed the judge directly.

He said: "It was an awful incident. I am not a big drinker and it got out of hand.

"I have been married five years. I'm a good dad, I love my son to bits and I have got two older children as well."

What happened to him?

Bramley, of Belper Road, Stanley Common, Ilkeston, pleaded guilty to assault by beating, assault occasioning actual bodily harm and driving a motor vehicle when over the alcohol limit.

District Judge Meachin handed him a 12-month community order.

This included 10 rehabilitation activity days and 120 hours of unpaid work.
