THANE: The Thane court has acquitted five members of family in an abetment to suicide case of a homemaker from Kalwa as the prosecution failed to prove the charges in court.
The prosecutor said that the prime accused is the husband of the deceased and the other accused include his parents and two brothers. The prosecutor added that the deceased and the prime accused got married on April 28, 2019, and she started residing with her in-laws in Kalwa.
Within three to four days of the wedding, the accused demanded a gold ring. A month later she went to her parents’ place for the holy month. Her mother-in-law told her to bring Rs 2 lakh for her husband. It was then that she told her parents that all the accused are harassing her mentally and physically on petty issues and even her brother-in-law had assaulted her physically on two occasions.
It was on June 29, 2019, that the deceased’s father got a call that her daughter has committed suicide by hanging and her body has been shifted to Kalwa hospital.
Subsequently a case of abetment to suicide, dowry harassment and physical assault was registered, and the accused were tried. The accused through their counsel denied all the charges in the court.
The judge observed in the order that the father of the deceased in his testimony told the court that after marriage she started residing with her husband and in-laws at Kalwa and she was treated properly at her matrimonial house. She had not told them anything about harassment done at the hands of the accused persons. He does not know for what reason his daughter committed suicide.
The judge in the order, noted, “no evidence is available on record to charge the accused persons with alleged suicide of the deceased, and for allegedly harassing the deceased to fulfil their illegal demand. From the material on record, it is clear that the prosecution has failed to establish that all the accused in furtherance of their common intention ill-treated the deceased mentally and physically and abutted her to commit suicide.”
