YORKTOWN, Ind. — The planned construction of a traffic roundabout has led to a lawsuit between the town of Yorktown and The Players Club golf course.
The suit — filed in recent weeks in Delaware Circuit Court 2 by attorneys for the town — said Yorktown needs to “acquire a portion of the real estate owned by The Players Club Inc.” to complete the roundabout project at Nebo and River roads.
The town also seeks a “temporary easement” across a portion of land owned by The Players Club “to develop the public improvements,” the lawsuit said.
The property involved would “not prevent or unreasonably interfere with the operations of The Players Club,” it added.
It indicated the town in June 2020 made an offer to purchase the property that was not accepted by the owners of the 18-hole golf course.
The lawsuit seeks to initiate eminent domain proceedings that would allow the town to acquire the property through condemnation.
It asked that Judge Kimberly Dowling appoint appraisers to “report the fair market value” of the land involved.
The town’s lawsuit was filed by attorney Alan Thompson of the Indianapolis law firm of Bose McKinney & Evans.
In a response filed last week, an attorney for The Players Club wrote the “compensation offered by the town of Yorktown is both inadequate and inconsistent with the law.”
