Hospital trip for accused Melbourne killer

A Melbourne man accused of killing a woman in her home has missed court because he's in hospital.

Alan Miller, 49, is charged with the murder of the 77-year-old woman, whose body was discovered by police during a welfare check at her Blackburn home on Monday.

He was due to face Melbourne Magistrates Court on Wednesday, but his lawyer Kyle McLaughlin asked that it go ahead in his absence while he is being treated for a lower leg infection.

The court heard Miller and the victim were related, but not what their relationship was.

He was arrested at the home after the discovery and charged with murder on Tuesday.

Police have until September 1 to prepare a brief of evidence, which is expected to include statements from a number of other family members who are living interstate.

Mr McLaughlin said the Blackburn man would need ongoing treatment for the infection once he is transferred into custody.

He also has a chronic inflammation condition.

Miller's case is due to return to court on October 13.
