SHIMLA: A court in Solan has awarded a resident of Uttar Pradesh 20 years’ rigorous imprisonment and Rs 25,000 fine for raping a six-year-old girl. In case of default of payment of fine, he will undergo additional simple imprisonment of one year.
The court also ordered Rs 9 lakh compensation, according to NALSA Compensation Scheme for Women Victims/Survivors of Sexual Assault/other Crimes, 2018, to the girl on account of relief and her rehabilitation. It also ordered that the 80% of compensation amount be deposited in a fixed deposit account in the name of girl till she attains the age of majority or for a period of three years whichever is later. The remaining 20% of the amount would be disbursed for her immediate rehabilitation.
In the judgment decided on Friday, the court of additional district and session judge Parvinder Singh Arora said facts and circumstances of the case suggest that the convict had sexually assaulted the girl despite the fact that he was provided shelter by her father as he had come to New Nalagarh in search of work.
Court also said compensation is to be paid to the victim from the State Victims Compensation Fund or other scheme or fund established for the purpose of compensation/ rehabilitating the victims under Section 357 (A) of CrPC and in case no such fund/scheme is established, then the compensation awarded is to be paid by the state government. Court had directed to supply the copy of this order to Child Welfare Committee, which will follow up and ensure the payment of compensation to the child.
