Highway Code rule could land you with £2,500 fine for sleeping in car while drunk

An obscure rule could land you with a hefty fine, or even prison time, for sleeping in your car.

You could be prosecuted if you're drunk in your car, regardless of what you're doing, because the law considers you to be "in control" of the vehicle.

Sleeping in your car while drunk comes under the Road Traffic Act 1988 because there's little guarantee you won't drive the car while under the influence, MyLondon reports.

The law says a motorist can be found guilty of an offence if they are "in charge of a motor vehicle on a road or other public place after consuming so much alcohol that the proportion of it in his breath, blood or urine exceeds the prescribed limit".

An exception to this is if you can prove you're unlikely to drive - for example, if you don't have your car keys.

Punishments for being in charge of your vehicle under the influence range from a £2,500 fine, 10 points on your licence or even prison time.

You might need to spend a night at a hotel or in a friend's house, or call a lift home, after a night of drinking so as not to fall foul of the law.

A new campaign seeks to limit the damage drunk driving causes on our roads, with a focus on actively discouraging the main group of drink drivers - young men.

Liz Brooker MBE, chair of Road Safety Great Britain, said: "Road Safety Great Britain fully supports the THINK! Pint Block campaign.

"Someone who gets in their car after drinking is a risk to themselves, and all others on the road, including their friends.

"This campaign highlights the role everyone has to play in reducing the number of people who drive, using the power of friendship to encourage safer driving and the need to protect those we care about."
