HC refers Prime Properties case back to single judge

HYDERABAD: The tussle between Prime Properties and Pilli Mallaiah and ten other farmers over 74 acres of land in survey number 1007 of Kukatpalli was referred back to a single judge.

This was done by a bench of Chief Justice Satish Chandra Sharma and Justice Abhinand Kumar that heard an appeal filed by Prime Properties. A single judge earlier upheld the claims of the farmers and directed the revenue authorities to issue them pattadar passbooks over the land.

Contending that they have rights over the land, Prime Properties counsel Satish Parasaran said that they are aggrieved by the order of the single judge that gave full rights to the farmers and hence filed this appeal. Senior counsel Surender Rao argued the case of the farmers and said that the farmers bought this land a few decades ago and that was regularised in 1995 itself. Satish said that the single judge in his order gave adverse conclusions against Prime Properties. The single judge in his order upheld the claims of the native farmers and directed the state to mutate the names of farmers in the web record of the revenue department . The bench after briefly hearing the appeal said that it would refer the matter back to the single judge.

The rival contentions of both parties can be freshly raised before the single judge, it said while asking the single judge to resolve the tussle within six months from now. It can be recalled a previous appeal filed by prime properties company was also referred to the single judge earlier.
