JAIPUR: Rajasthan High Court on Wednesday dismissed the petition of garbage collection company BVG against the cancellation of its contract by JMC. The high court had earlier barred the corporation from taking any punitive action against the firm.
The company had filed a petition in the high court against the corporation for not executing a supplementary contract after the division of the civic body and attempts to cancel the contract.
The court had stayed the civic body from taking punitive action the company in May 2021 and asked the firm to continue working.
The company had filed a petition in the HC saying the local bodies department had asked both the corporations to enter into supplementary contracts for garbage collection. In compliance of this order, JMC-Heritage entered into a contract, but the supplementary contract letter had has not been issued by JMC-Greater. It rather wanted to end the contract.
On behalf of the civic body, additional advocate general Anil Mehta argued that the corporation was not bound to execute a supplementary contract as the terms and conditions were being continuously violated by the company due to which the corporation now wanted to cancel the contract. The Rajasthan Employees Federation also alleged that the company had not been doing its duty as per the set condition and criteria.
The company claimed that they are working in many places of the country and their reputation was involved.
After hearing all the parties, Judge Inderjit Singh dismissed the firm’s petition. With the dismissal of the petition, the stay of cancellation of the contract of the company has also ended. Now JMC-Greater has got the freedom to take action against the company. JMC-Heritage has already cancelled the contract of the firm.
