Guilty plea over indecent assault of girl, aged 9

A man indecently assaulted a young girl in the Hunter Region in 2018 after being released from prison for child sexual abuse, according to court documents.

The man pleaded guilty to one count each of indecent assault of a person under 16 years of age and failing to comply with reporting obligations when he faced Newcastle Local Court on Wednesday.

One charge of sexual intercourse with a child under the age of 10 years old was withdrawn and dismissed.

The Newcastle Herald is not naming the man, in order to protect the identity of the young girl.

According to a statement of agreed facts tendered to the court, the man was released from jail for child sex abuse in March, 2018.

At that time, he rekindled a relationship with a woman in the Newcastle area who had been his partner before he was jailed.

The woman had three children, including the nine-year-old girl who would become the man's victim.

Under the Child Protection Act, the man was not allowed to be around children after his release from jail for his previous conviction.

But the statement of facts said the man broke that condition on five occasions in 2018 by being at the woman's house while children were at the premises.

On one such occasion, the facts noted, the nine-year-old girl was on her mother's bed watching TV when the man entered the room and got onto the bed near her.

According to the facts, the man lay beside the child before he pulled down her pants and underwear and rubbed his genitals on her buttocks.

Court documents said the child "felt unsafe and uncomfortable" and the man told her not to say anything to anyone about the incident.

The facts said the girl did not see the man again.

The girl's mother was at the home at the time, but was occupied with the other children.

Police were alerted last June, when the child disclosed the incident at school and the principal contacted the authorities.

They arrested the man at a Sydney police station a short time later and he was charged.

Magistrate Robert Stone on Wednesday adjourned the matter to Newcastle District Court for sentencing.

The man, now aged 42-years-old, remains in custody. He will face court again on March 25.
