A former lorry driver refused to do a breathalyser test because he was "ginger."
Kenneth McDickens, 50, was traced by police on March 12 this year.
He had been reported after crashing into bollards outside of a property in Glasgow.
The driver initially refused a breath test at the scene before being brought into police custody.
McDickens was asked for a second time and failed to comply stating: "Because I'm ginger."
McDickens pled guilty at Glasgow Sheriff Court to failing to provide two breath specimens for analysis.
The court heard the driver, who has short black hair, was behind the wheel at 10.55pm.
Prosecutor Sean Docherty said: "A witness heard a loud bang outside her property and looked outside.
"She saw a vehicle had crashed into bollards and saw a man leave before contacting the police."
McDickens was traced to his home 30 minutes later where he was deemed to be under the influence of alcohol.
He was arrested and asked to provide a sample of breath which he failed to do so without reason.
McDickens was taken to the city's Helen Street police office.
Mr Docherty added: "He was asked again to provide two samples of breath for analysis but he refused to do so.
"He said his reason was 'because I'm ginger'."
McDickens was arrested and in reply to his caution and charge he stated: "I'm a scumbag."
Tracy Patterson, defending, told the court that McDicken's believes he is lucky no one was injured as a result of the incident.
The lawyer added: "His employers City Building have accommodated him through these offences.
"He could return to his employment and could go back to lorry driving.
"That's what he did for most of the time working at his employment."
Sheriff Valerie Mays fined McDickens, of the city's Pollok, £585 and disqualified him from driving for 16 months.
She said: "This does seem out of character for you."
