'Get to f**k you fanny' Tesco van robbery foiled by bystander who confronted armed thief

A robber who held up a Tesco home delivery van and stole a box of Budweiser was foiled after an onlooker intervened, told him "don't be a fanny", and handed the beer back to the driver.

Dillon Martin, 22, who was holding a broken bottle, approached Tesco driver Alan McAinsh as he returned to his van after dropping off shopping in Camelon, Falkirk.

Prosecutor Michael Maguire told Falkirk Sheriff Court: "Mr McAinsh had come out of a house and saw two males walking towards his van.

"He returned to the vehicle with his trolley and trays, put the trays back in the van, closed the shutter, and locked it.

"Martin approached him and said, 'I want something out of the van. I want a f***ing carry-out.'"

Mr McAinsh told Martin, "It's not happening, pal", but Martin pulled out a broken glass bottle, and, still holding it, told Mr McAinsh to open the van.

The court heard driver then opened the van and told Martin to take what he wanted.

Witnesses watching from nearby houses saw the driver standing with his hands in the air with Martin "looking very aggressively at him".

Martin opened the side shutter of the van, leaned in, and took out a box of Budweiser.

A 23-year-old man, who had also been watching from his window, then went out to intervene.

Mr Maguire said: "The man noted that the accused was holding the box of Budweiser under his arm, and a broken bottle in his right hand.

"He grabbed the Budweiser and told the accused, 'Get to f**k you fanny'."

Martin then ran off towards Carmuirs Avenue, Camelon, while the witness walked back to the Tesco van and returned the Budweiser to the driver.

The incident happened about 6.35 pm.

Martin had been recognised by several witnesses, who told police who had been responsible, and he was arrested less than two hours later.

Appearing by video link from Low Moss Prison on Tuesday, Martin, of Tamfourhill, Falkirk, pleaded guilty to assault and robbery in the incident in Wall Street, Camelon, Falkirk, on April 3, 2019.

An allegation that he had "brandished" the broken bottle at the driver during the robbery was dropped by the prosecution.

Martin also admitted two charges using threatening and abusive behaviour and two of assault in other incidents in Bonnybridge, Stirlingshire in May this year (2020).

Solicitor Dick Sandeman, defending, said: "Drink had been taken to the state of befuddlement, and to do that to a Tesco delivery driver was an extremely foolish act."

Sheriff Derek Hamilton jailed Martin for two years.
