Gateshead man breached his bail conditions after being caught in a garden

A man accused of going equipped for burglary breached his bail conditions by associating with a co-accused and breaching an overnight stay-at-home curfew three times.

Christopher Carr, 21, was spotted by a police community support officer with the man in a Gateshead garden on Wednesday, April 28, South Tyneside Magistrates’ Court heard.

Under the terms of his bail, he must not associate with two co-defendants and abide by an 11pm to 8am curfew and live and sleep at home in Pottersway, Carr Hill, Gateshead.

Prosecutor Ben Woodward said Carr also went out during parts of his curfew hours on Friday, April 23, and Friday, April 30 – and for the entirety of the curfew on Sunday (Note - May 2).

Of the garden breach, Mr Woodward said: “He should have left when the other person arrived.”

Carr denied both breach charges but they were found proven by magistrates.

Alaister Naismith, defending, said Carr had inadvertently ended up in the same garden and had not orchestrated the meeting.

He also claimed there was an issue with the electronic monitoring box installed at his client’s home which checks that he is indoors during his curfew.

Mr Naismith added: “I think it’s quite suspicious that it’s recorded him as not being at the address and then absent for the whole nine-hour period.”

Magistrates reapplied his bail conditions but changed the non-association element to a no contact order.

Carr is charged with going equipped on Tuesday, April 6, and will be tried in South Tyneside on Tuesday, August 24.

He has already pleaded guilty to several motoring charges on the same day, including dangerous driving.
