Gargasoulas too unwell for court: lawyer

The man accused of the Bourke Street rampage is not well enough to attend court, his lawyers have told a Melbourne magistrate.

James "Dimitrious" Gargasoulas, 27, was due to face the Melbourne Magistrates' Court on driving and theft offences unrelated to the Bourke Street incident.

However, his barrister, Tass Antos, asked the magistrate to excuse his client from the hearing because of his mental health.

"He is not very well," Mr Antos said.

"Having him in court would not do his mental health any good."

Pressed on what that meant, Mr Antos said he did not have medical information as Gargasoulas had not been assessed.

Mr Antos said Gargasoulas' mental health was yet to be examined by experts.

Gargasoulas is also charged with six counts of murder and more than 20 counts of attempted murder over January's Bourke Street rampage.

His lawyers told the court his mental health assessments could determine how his criminal cases are handled, but could take some time.

At past court hearings he has made outbursts from the dock blaming the illuminati for his behaviour and declaring himself "a saviour".

He remains in custody at the Melbourne Remand Centre.
