Friend asleep beside woman during sex attack, court told

Editor's note November 28, 2017: Brian Maan was acquitted of all charges in December 2009. He was found not guilty on all counts.

A woman has told a Canberra court how she tried to stop a former school mate assaulting her.

Brian Maan is accused of trying to sexually assault the 23-year-old woman at her house in 2007.

The woman told the ACT Supreme Court, after a night out, she went home in a taxi with a girlfriend and Maan.

When they arrived at her house she said she told Maan to continue home in the taxi but he said he did not have enough money.

All three ended up sleeping in the woman's bed.

The woman said she woke up during the morning and felt Maan trying to sexually assault her.

In cross examination, she said her female friend was asleep beside her during the attack but she did not move towards her.
