Fraud suit against FAU coach Lane Kiffin dismissed by Alabama judge

Florida Atlantic coach Lane Kiffin picked up another victory Thursday when a fraud suit filed against him was dismissed by an Alabama judge.

According to published reports, the decision was made Oct. 10.

Kiffin, who was the Alabama offensive coordinator before arriving at FAU last December, was charged with fraud by former Crimson Tide receiver Antonio "A.C." Carter. He alleged Kiffin and FAU strength coach Wilson Love offered him a position with the Owls in exchange for help to sign a prospective recruit.

The recruit was signed by FAU. Carter claimed the school offered him the job Jan. 25 but revoked it nine days later. In that time period, Carter said he helped recruit three prospects but was never compensated for his work. According to the suit, the position paid $40,000 annually plus bonuses and up to $4,000 for relocation.

Carter leveled six counts against Kiffin, FAU and Florida, including reckless fraud, breach of contract, and unjust enrichment.

The job offer was rescinded after two misdemeanor criminal charges surfaced in Carter's past. Carter's attorney said they stemmed from a 2010 Florida case when Carter was in the same car as drug paraphernalia and driving in Alabama without a license.

The case can't be refiled because it was dismissed with prejudice.

Kiffin is 3-3 in his first season with the Owls. They face North Texas Saturday at FAU Stadium with first place in Conference USA on the line.
