Former soldier has been spared jail for growing cannabis

A successful former soldier has been caught for a second time producing cannabis.

Athlete Ezekiel Benjamin had been in the Sherwood Foresters and had completed two tours of Afghanistan and saw action on the frontline.

He was a rifleman and private training instructor.

Nottingham Crown Court heard in 2015 he received a suspended prison sentence for producing cannabis to supply.

Now he has appeared in court again for producing the drug.

Nine cannabis plants were found in a tent, eight in another room and there were more plants in a box room.

Brian Outhwaite, prosecuting, estimated there were between 532 grams and 1,500 grams and the estimated value was between £5,320 and £15,960.

Benjamin, 34, of Thomas Close, St Ann's, pleaded guilty to producing the Class B drug.

Roger Wilson, mitigating, said there was a pre-sentence report which told the judge a great deal about Benjamin's past.

He has been working in retail outlets throughout the UK nearly seven days a week.

"He just wants a normal life," said Mr Wilson.

"You know why he smokes cannabis. His GP is not happy with it. He has been a successful soldier and athlete. He was in Sherwood Foresters and did two tours of Afghanistan, was a rifleman and a private training instructor".

Judge Timothy Spencer QC decided to give Benjamin a 12-month prison sentence, suspended for one year.

He said it was the second time that Benjamin had been growing cannabis.

But he took into account that "you seem to have turned your life around".

"I'm impressed with anyone who serves their country particularly the way you have. This really is the last chance. There must be no more cannabis grows or offending of this sort".

And he warned Benjamin: "Don't come back".

He replied: "I will not, your honour".
