Former soldier from Wythenshawe accused of terror offences has case dropped

A former solider who was charged with terror offences after being accused of wanting to fight against Islamic State alongside Kurdish militia in Syria will not be prosecuted.

The case against Daniel Burke, 33, from Wythenshawe, has been dropped after applications from his legal team.

He was remanded in custody in December after being stopped by the authorities.

Mr Burke, who previously served in the Parachute Regiment, told officers in Dover it was 'a joke'.

He said: "I’m not a terrorist; you know I am not a terrorist. I have done nothing but fight for this country."

Prosecutors had alleged Mr Burke had repeatedly shown a desire to leave the UK to return to Syria in order to fight for Kurdish militia.

He was charged with three terror offences, including helping Daniel Newey, another British man who had allegedly gone to Syria last year.

A hearing at the Old Bailey also heard that charges against Mr Newey’s father Paul, 49, and brother, Sam, 19, from Solihull in the West Midlands, who were both accused of helping him, had also been dropped.

Prosecuting, Simon Davis said a review of the case had found there was no longer a 'realistic prospect of conviction'.

Andrew Hall QC, for Mr Burke, told the court it was in the 'interests of justice' that the reasons for the decision were known.

Mr Justice Sweeney adjourned the hearing to allow the prosecution time to consider the matter.

He said: "I appreciate there may be public interest sensitivities involved because this decision has been taken in the context of a disclosure exercise but reconsideration may make the prosecution cast more light on the decision."

Mr Burke, of Amberwood Drive, Baguley, Wythenshawe, had faced three charges.

The first alleged that he had assisted Daniel Newey to commit, prepared or instigate an act of terrorism last October.

The second alleged he was involved in an arrangement with others to provide money and military equipment, while having reasonable cause to suspect that it would or may be used for the purposes of terrorism.

He was also charged with engaging in conduct in preparation to commit, prepare or instigate an act of terrorism between October 7 and December 7 last year.

A CPS spokesperson said: “As part of our responsibility to continuously keep cases under review, we have concluded our legal test for a prosecution is no longer met.

“We have therefore offered no evidence in the case against Paul and Samuel Newey and Daniel Burke.”
