A man convicted for the 2019 death of a Filipina transgender woman in Wagga Wagga is expected to be re-sentenced next week.

Rian Ross Toyer, a former corporal in the Royal Australian Air Force (RAAF), was sentenced on Friday for the manslaughter of Mhelody Bruno after she fell unconscious when he choked her during sex.

After receiving a 25 per cent discount for his guilty plea, Toyer was sentenced to a 22-month intensive correction order (ICO) with conditions including 500 hours community service.

The case has been listed to be re-opened and Toyer re-sentenced next Monday.

A spokesperson from the New South Wales Office of the Director of Public Prosecutions said the parties to the case raised with the judge that "an ICO could not be imposed for a manslaughter".

"The matter is now listed for a s43 sentencing error correction."
