A former Chicago police officer has pleaded guilty to battery for hitting a man with his baton in a 2014 incident captured on cellphone video.
Brett Kahn faced 11 felony counts when he was indicted in 2016, including aggravated battery with a deadly weapon and official misconduct, according to court records.
Kahn pleaded guilt Thursday to a misdemeanor count of battery that had been downgraded from an official misconduct charge as part of a plea deal with the Cook County state’s attorney’s office.
The 10 other felony counts Kahn faced were dropped.
Judge Arthur Hill sentenced Kahn to two years’ probation and issued a law enforcement de-certification order, meaning he can no longer work as a police officer in the state, a spokeswoman for the state’s attorney’s office said.
Kahn was fired from the Chicago Police Department last year in connection with a separate excessive force incident in June 2014, a police spokesman said Friday.
On July 11, 2014, Kahn allegedly saw Lisa Simmons drinking alcohol from a plastic cup in the 1500 block of South Christiana Avenue, the Sun-Time previously reported.
A cellphone recording showed Kahn forcibly holding Simmons, 43, against a squad car while trying to place her under arrest as a crowd gathered around him.
After yelling at the crowd to move away, Kahn took out his baton and walked over to 30-year-old Jeremiah Smith and struck him in the head.
According to an arrest report, Kahn said he believed Smith was trying to punch him.
