Former 49er Bruce Miller charged with using cane to beat elderly man

SAN FRANCISCO _ Prosecutors charged former 49ers tight end Bruce Miller on Thursday with seven felonies and one misdemeanor, including beating a 70-year-old man with a cane in a drunken assault earlier this week at a Fisherman's Wharf hotel.

The San Francisco District Attorney's Office said Miller, who has since been released by the San Francisco 49ers, is scheduled to be arraigned at 1:30 p.m. Friday. He was arrested Monday after he stumbled into a San Francisco hotel and assaulted a 70-year-old man and his son, according to police. The two victims were taken to a hospital with injuries.

A surveillance video showed an inebriated and bleeding Miller at the hotel.

His charges include multiple allegations and enhancements for the commission of a crime against an elder adult, according to San Francisco prosecutors. The stunning revelation Thursday from his charging documents was that Miller allegedly beat the elderly man with what appears to be the 70-year-old's own cane.

His felonies include:

One count of assault with a deadly weapon, not a firearm (weapon alleged is a cane); one count of assault with force likely to cause great bodily injury; one count of inflicting injury on an elder or dependent adult likely to cause great bodily injury; one count of battery with serious bodily injury; two counts of criminal threats; and one count of assault with force likely to cause great bodily injury.

According to a statement issued by San Francisco police, Miller tried to enter a hotel room that was occupied by the 70-year-old man and his 66-year-old wife. The son, who was in the next room, told Miller he was in the wrong room when Miller "charged at him, starting a physical altercation."

The father was injured when he came to his son's defense, according to the statement.

Authorities said Miller then ran off to a Travelodge across the street, where he was taken into custody.

The 49ers released the tight end Monday, hours after he was arrested. He played in 77 games with the 49ers, with 47 starts at fullback, after being a seventh-round draft pick in 2011 out of Central Florida.

Miller has been in trouble with the law before. In 2015, he pleaded no contest to a misdemeanor charge of disturbing the peace after an argument with his girlfriend, and attended a 16-week domestic counseling course.
