CHENNAI: An owner and a cook of an Arni-based hotel, arrested for the death of a child allegedly due to food poisoning after consuming briyani from the hotel, have secured bail by volunteering to pay 10 lakh as compensation to the family of the victim-girl.
Amjath Basha and Muniyandi are in jail since September 12. "Considering the period of incarceration undergone by the petitioners and the fact that they are ready to pay 10 lakh as compensation to the complainant, this court is inclined to grant them bail," said Justice M Dhandapani on Friday.
The judge then granted them conditional bail and directed them to appear before the investigation officer daily at 10.30am for two weeks and thereafter as and when required for interrogation.
According to the prosecution, on September 8 complainant Priyadharashni had dinner at 7 Star Biriyani Hotel in Arni along with her family. The next morning all of them fell ill due to food poisoning and thereafter her daughter died.
Based on her complaint, police arrested Amjath Basha and Muniyandi on September 12 for offences under Sections 308 (attempt to commit culpable homicide) and 304(2) (causing death due to negligence) of IPC. When their plea for bail came up for hearing before Justice Dhandapani on Friday, counsel for the petitioners submitted that they maintain quality in the hotel, however, the incident had happened inadvertently. He further submitted that the petitioners, without prejudice to their rights, are willing to pay Rs 10 lakh as compensation to the complainant who is the mother of the deceased girl.
