Fisherman claimed he was stabbed after spat over sharing pond

A fisherman claims he was stabbed by another angler after he confronted him for taking up too much room at a pond.

Samual John Harbison, 41, kicked off after accusing two men of hogging the water at Ferguslie Gardens.

He insisted he was jabbed with a screwdriver.

Connor McLeod, 22, was arrested over the alleged attack.

But he was cleared after the case collapsed at Paisley Sheriff Court this week.

Mr Harbison was unable to identify the man he says hit him.

He said: “I was stood right next to them because all the fish were right round the one side.

“That’s where all the carp were sitting.

“They all just sit at the one spot because that’s where the sun hits.

“I was having an argument about the fishing and it just escalated into a scuffle.

“I’d been stabbed at the pond.

“I’m not sure who by but it must’ve been one of the guys – I never stabbed myself.”

Mr Harbison was at the park with pal Daniel Agnew, 42.

He says tempers flared over the amount of room that was being taken up by rival anglers.

He claims he was stabbed while his friend was at the other side of the pond in Paisley’s west end last May 24.

Mr Harbison added: “Before Danny even lifted his head, it was finished.

“I was on my knees and the next minute I got volleyed in the face and my nose was burst.

“It was a yellow-handled screwdriver.

“It’s as if I can see it right now.

“It’s the only thing I’m 100 per cent sure about.”

Mr Harbison denied claims he had brandished a weapon at McLeod and his friend.

The court heard he had confronted them and fumed: “you’re kicking the a**e out of it.”

He denied trying to attack the pair with fishing forceps.

Mr Harbison continued: “Those are not for fighting, they’re for fishing.

“I’ve never used a weapon in my life, neither I have, it’s as simple as that.

“If I’m going to fight somebody, I’ll fight them with my hands.

“I had been chasing one of them about the park with a fishing rod as I noticed I’d been stabbed and I was very, very angry about it.

“At first I thought I’d just been punched.

“I was chasing the guy about the park with a fishing rod.

“I ran over and tried to hit him with it and that’s when the police came.”

Prosecutor David McDonald revealed he was no longer seeking a conviction when Mr Harbison could not identify his
attacker.

McLeod, of Port Glasgow, was told he had been acquitted, and walked free from court.
