Fatal crash driver not guilty, court rules

The Northern Territory Supreme Court was told Robert Spencer had been involved in three previous accidents in the years leading up to a fatal crash.

A man who caused a fatal car crash in Darwin has been found not guilty of any offence because of his neurological and congenital deficiencies.

The Northern Territory Supreme Court heard that 69-year-old Robert Frank Spencer was driving erratically on a busy section of the Stuart Highway when he failed to stop at a red light and crashed his vehicle into a stationary car in May 2012.

The driver, Ben Wilton, 29, was killed instantly when his car exploded after its fuel tank ruptured.

Justice Stephen Southwood found Mr Spencer not guilty of dangerous driving and causing death, due to mental impairment.

The Court heard Mr Spencer had been involved in three previous accidents in the years leading up to the fatal crash.

He had undergone a fitness to drive assessment and held a licence at the time of the last accident.

Justice Southwood placed Mr Spencer on a non-custodial supervision order.

This has a number of conditions, including not being allowed to drive, and remaining under the care of his doctor and wife in Darwin.
