Texas’ top criminal court overturned his conviction, but now a former Texas high school football coach is back on trial.
CBS Dallas/Fort Worth reported that former Alief Hastings (Houston) High School coach David Temple will be on trial again for the 1999 murder of his wife. Temple’s conviction was originally overturned because prosecutors withheld evidence. The Texas Court of Criminal Appeals stated that the trial would have gone differently if Temple’s attorneys would have received hundreds of pages of police reports from the prosecution.
Temple has claimed that his wife, who was pregnant at the time of the murder, was killed on a break-in gone bad. The prosecution has claimed that the burglary was staged by the football coach and that he did it because of his affair.
