Ensure no tainted officer posted to head anti-graft agencies: Karnataka HC to chief secretary

BENGALURU: The high court on Monday said before posting an officer to an institution which is established to prevent corruption, the chief secretary (CS) has to consider that the said officer has credibility and the capacity to helm the institution and take it to great heights.

Justice HP Sandesh gave this direction while hearing a bail petition filed by an accused in the Bengaluru Urban DC office bribery case. “While posting the officer to helm the institution to fight and prevent corruption i.e., ACB, the secretary to DPAR should also provide all materials (service records) to the chief secretary vis-a-vis integrity of the officer,” the judge said in his order.

Dwelling further, justice Sandesh said the posting should not be due to any other consideration like external or internal influence.

“The same (influence) cannot be a criterion while posting an officer to the institution. The officer who has to be posted to the institution established to fight prevention of corruption and his family members or any other person should not face any investigation by ACB or Lokayukta and or otherwise,” the judge added.
