Edinburgh mum of tragic Keane Wallis-Bennett to receive council payout over death

The mother of an Edinburgh schoolgirl killed when an unstable wall fell on top of her is to receive an out of court settlement from council chiefs, according to reports.

Keane Wallis-Bennett tragically passed when an unstable 6ft partition collapsed in the gym block of Liberton High School in 2014.

A Fatal Accident Inquiry (FAI) later determined ‘no one was responsible’ for the incident, but mum Abbie Wallis launched legal action in an attempt to have someone ‘accept accountability’.

However, the Scottish Sun has now reported the 41-year-old had agreed a payout from City of Edinburgh Council over the 12-year-old’s death.

A Court of Session spokesperson told the newspaper that both parties had settled the case.

A ten-day FAI in August 2017 found the “inherently unstable” barrier had structural damage in its base.

It has since been demolished and replaced after sheriff principal Mhairi Stephen determined that the actions of pupils ‘over many years may have unwittingly contributed’ the wall cracking.

But she added: "There are no reasonable precautions I can propose whereby Keane's death or the accident might have been avoided."

Ms Wallis launched legal action against the council in 2018, but it is understood the size of the settlement will not be made public.

A City of Edinburgh Council spokesperson said: “We want to express our deepest sympathies again to Keane’s family for their tragic loss however as this is a legal matter it would be inappropriate to comment further.”
