Drunken boyfriend attacked partner while on bail for assaulting her mum

A drunken boyfriend attacked his partner and left his flat covered in blood while he was on bail for assaulting her mum.

Andrew Kelly and his girlfriend Louise Mackenzie were arguing at his flat in Walton about his attack on her mum before he subjected her to a 'sustained' assault.

The 44-year-old left her with a severely split lip which required up to 20 stitches and bruising to her arms and legs.

The couple both left the property in Grey Road after the attack, and because they'd both been drinking heavily, Ms Mackenzie said she had little recollection of the incident on September 23.

Kelly telephoned for an ambulance and told paramedics his girlfriend had been assaulted by another man, while she explained in a conversation with paramedics that she'd fallen.

But when Ms Mackenzie returned to her mum's address, she encouraged her daughter to go to the police and Kelly was arrested.

Liverpool Crown Court heard how he initially told detectives his girlfriend had fallen, but he later admitted assaulting her, although he claimed the 33-year-old sustained her most serious injury while falling from the blow.

Derek Jones, prosecuting, said Kelly and his partner had been in a 'volatile' 18-month relationship, now over, with the Probation Service referring to 'previous call-outs.'

The 44-year-old, who has 17 previous convictions for 30 offences, was convicted in October for the attack on Ms Mackenzie's mum, when he was fined and a restraining order was imposed.

Charlotte Kenny, defending, said her client had been in prison on remand for the past two months, which he had found a 'disturbing and difficult experience.'

Kelly was locked up for 23 hours a day in his cell, which he shared with two other inmates, due to the coronavirus pandemic, she added.

Ms Kenny said her client was 'full of remorse' and had 'battled drink for a number of years...but when abstaining from alcohol, he is somebody who simply does not offend.'

Kelly lost his dad in 2018, leading him to drink, and his relationship with Ms Mackenzie was 'centred around alcohol', the court was told.

Ms Kenny urged Recorder Tom Gilbart to suspend Kelly's prison sentence, meaning he would walk free from court.

But the judge disagreed and told her only an immediate custodial term was appropriate, and jailed him for 12 months.

He told Kelly, who pleaded guilty to unlawful wounding: "She [Ms Mackenzie] does not recall quite how you had struck her, but describes having a significant amount of blood and bruises to her legs and arms.

"I've seen the photographs of the victim's [injured] face and it is unpleasant to see.

"This was a sustained assault, an unpleasant act of domestic violence which required hospital treatment and stitches and happened while you were on bail."
