Drunk described as 'disgraceful' after launching verbal abuse at police

A Kilmarnock man who shouted profanities at police officers in Crosshouse Hospital has been described by his own solicitor as “disgraceful”.

David Neil was rushed to hospital by ambulance after a member of the public found him lying on the street.

However, after arriving at Crosshouse Hospital in Kilmarnock, staff were forced to call police due to Neil’s intoxicated state.

When officers arrived on the scene Neil, of Cruachan Place, began shouting and swearing at police calling them, amongst other things, “stupid c****.”

The 40-year-old appeared before Kilmarnock Sheriff Court last week where he pled guilty to behaving in a threatening or abusive manner by shouting and swearing on March 22, this year.

The fiscal depute told the court how police were called to Crosshouse Hospital just after midnight due to reports of an intoxicated male.

The prosecutor said: “They attended immediately and observed the accused lying sleeping in the communal area.

“On rousing the accused it became clear he was under the influence of alcohol.”

Neil became aggressive towards officers shouting “f***ing useless b*******” and “f****** pricks” and, upon being arrested, he called the police “stupid c****”. The fiscal told the court how the comments had been made for all the hospital to hear and Neil was subsequently arrested and taken to Kilmarnock Police Station.

Defending Neil, solicitor Neil McPherson told the court: “Since his release last year this is the only incident which has come to the attention of the court.

“The background to this is that he had been taking too much alcohol.

“A member of the public found him in the street and dialed 999, an ambulance arrived and took him to A&E at Crosshouse.

“He must know there’s quite a lot going on without people behaving badly.

“They [hospital staff] put a nappy on him and when the police found him in the corridor with the nappy he behaved badly.”

He added: “He is a man with a horrific criminal record but an alternative to custody could allow him to give back for his disgraceful behaviour.”

Sentencing, Sheriff Shirley Foran told Neil: “This is frankly a terrible waste of stretched public resources.

“When woken from an intoxicated state the first thing you did was shout and swear in a public environment.”

The case was for deferred until August 2 for background reports.
