Drug user breached nine year-old ASBO

A drug user with a “horrendous” criminal record broke a nine-year-old ASBO.

Jason Smith, 35, of Galloway Avenue, Ayr, was also found to have £40 worth of heroin when police arrested him.

Smith appeared at Ayr Sheriff Court last week and admitted breaching his Asbo, which dates back to 2010.

He breached the terms of it on November 16 last year, when he allowed others to shout and allowed a disturbance to take place in Walker Road, Ayr.

In addition he admitted being in possession of heroin at Ayr police office on April 19 this year, breaching his bail conditions from February 21 at Ayr Sheriff Court.

Fiscal depute Scott Toal said: “A complaint was made after neighbours became aware of banging and shouting and somebody trying to gain entry and the accused was heard arguing with somebody.”

Police were called and on arrival they could hear loud noises.

“Another male let officers in and they found the accused drunk. He was arrested,” said Mr Toal. The £40 worth of heroin was in four bags.

Defence solicitor Ian Gillies said: “He has a horrendous record and he accepts that but there’s nothing further and there’s been no repetition from his Asbo.

“He has an ongoing drugs problem and he’s trying to deal with it. He would benefit from some structure in his life.”

Sheriff David Bicket put Smith under supervision for 18 months and ordered him to do 160 hours of unpaid work.

Smith was also fined £150, payable at £10 per fortnight.
