Driver drove with his victim 'trapped under his car', says judge as he sends him to jail

A driver who killed a man by driving dangerously on the Forest Recreation Ground park and ride had driven for a considerable distance with the man's body trapped underneath the car, said a judge.

Mr Justice Jeremy Baker sentenced Marius Caraleanu, 25, of Randal Gardens, Hyson Green, to ten years and eight months for causing the death by dangerous driving of father-of-four Omar Shafiq.

Romanian-born Caraleanu was banned from driving for ten years and four months.

And the judge made a deprivation order on the defendant's bright blue Citroën C2 - the car he was driving on the night of the fatal and tragic crash on Tuesday, October 23 last year.

Mr Shafiq and his partner had earlier been at a flat with others where there was an argument. One man left with two mobile phones which belonged to the flat owner.

They later all met up at the park and ride for the phones to be returned.

At the same time, Caraleanu was taking a prostitute to her car to collect some belongings.

The court did not hear about any connection between the defendant and the people in the car park. Caraleanu's barrister claimed his client's car was attacked.

After the prostitute got out of his car, Caraleanu drove at speed towards the man who was there to drop off the phones, stopped abruptly and got out and chased him.

"This episode was captured on CCTV on the site, as was your run to your motor vehicle a few seconds later on foot," the judge told him in the dock.

"When you got back into the driver's side, instead of driving off towards the direction your car was facing towards the exit, you twice drove in the opposite direction, back towards where the man (who took the phones) had last been heading.

"Fortunately much of what took place at this point was not captured on CCTV".

The judge accepted that at some point the man and Mr Shafiq struck out at his car with feet and weapons.

However, the judge said, it was apparent from some witnesses' evidence that he drove in an aggressive manner towards the two men.

Whilst one was able to get out of the way of the car, the "deceased was not so fortunate", said the judge.

"He was struck by the motor vehicle, causing his body to be sucked underneath it.

"Instead of stopping, you continued to drive your motor vehicle for a considerable distance, whilst the body was trapped underneath it, before the body was ejected onto the surface of the park and ride site, as was graphically shown on the CCTV.

"Tragically, the deceased, 47, died from the multiple chest injuries and lacerations he suffered in the incident".

Martin Heslop QC, mitigating, had told the court Caraleanu was in panic and afraid for his safety after his car was "savagely attacked".

"He insists he never intended to kill or cause grievous bodily harm to anybody.

"I express, on his behalf, his genuine remorse and sadness at what happened".
