Driver banned after failing breath test the day after he 'had a skinful'

A drink driver 'had a skinful' while watching the Cricket World Cup and failed a breath test a day later.

Scott Shaw, 55, was stopped by police after his partner called them following an argument, city magistrates heard.

Serena Cousin, mitigating, told the court: "She didn't think he would be over the limit but he was.

"This was not an intentional driving offence, this is the day after drinking.

"He had a skinful watching the World Cup cricket final. The offence was on the Monday and he felt OK to drive. He was shocked when he blew over the limit."

An 18-month driving ban was imposed on Shaw of Rivergreen, Clifton. He admitted driving with 67 micrograms of alcohol in 100 millilitres of breath on Maid Marian Way. The legal limit is 35.

Miss Cousin said the disqualification would be a big penalty for Shaw, who has just launched a business with a catering van.

Daniel Pietryka, prosecuting, said Scott was stopped when driving at 8.50pm on July 15 after "information was received by the police."

Shaw was fined £120 and must pay £85 prosecution costs and a £32 government surcharge. If he completes a course on the dangers of drink driving, his disqualification will be reduced by 137 days.
