Drink-driver 'misjudged his alcohol consumption' when he drove over the limit

A drink-driver "misjudged his alcohol consumption" when he drove over the limit after an argument with his ex-partner.

Police noticed Carl Robb's Volkswagen Caddy being driven erratically on March 14, Nottingham Magistrates' Court heard.

He was stopped and did a roadside breath test, admitting to officers he had drunk alcohol earlier that night. He was driving a work vehicle but was not working at the time.

He pleaded guilty to driving in a road called Leafield, Retford, when he had 70 micrograms of alcohol in 100 millilitres of breath, over the limit of 35.

Robb, who was of previous good character, has been suffering from mental health issues, explained his lawyer, Andrew Bevan.

This was following the breakdown of a relationship. On this particular night, he had an argument with his ex-partner.

He went for a meal with friends in Retford and did not intend to drive back and misjudged his alcohol consumption, said Mr Bevan.

"On the way back, he was stopped by police and failed a roadside breath test," he added. "He is extremely remorseful".

After Robb, 39, of Underwood Avenue, Torworth, Retford, was arrested he disclosed this to his employer and was dismissed as a result of gross misconduct, the court heard. He was then diagnosed with epilepsy and surrendered his licence.

Robb has since applied for 374 jobs, had a number of offers but had to decline or withdraw as he was unable to drive.

He went on Job Seeker's Allowance, and got into quite a bit of debt as a result, but on September 16 he got a job with Amazon and now earns £314-a-week.

Magistrates decided on a £300 fine, £85 costs, a £32 victim surcharge, and a driving ban for 18 months. He has been offered a drink drive rehabilitation course which would reduce his driving ban if completed.
