Prosecutors in charge of a doomed Rangers fraud probe didn’t have a case which was “fit” to be brought to court, a senior judge has heard.
Andrew Smith QC told judge Lord Tyre yesterday how the Crown Office’s belief that his client David Grier was involved in wrong doing failed all legal tests.
Mr Smith told the Court of Session that prosecution lawyers had no right to take Grier to court in relation to alleged crimes during businessman Craig Whyte’s takeover of the Glasgow side.
He told the court: “This was not a case that was fit to put into court.”
He also claimed that Scotland’s prosecution service acted unlawfully at all stages during the probe.
Grier is suing Lord Advocate James Wolffe QC for £5million, claiming that prosecutors had no evidence which warranted having him arrested and charged.
