Disqualified driver flipped car on its roof after taking friend's BMW

A disqualified driver who flipped a car after failing to stop for police has been given a further ban from the roads for three years.

Lynden Brown, 37, of Rydale Grove, Basford, was arrested on November 5, 2018 after taking his friend’s BMW without permission and following a short pursuit by police, crashed the car, flipping it on to its roof.

Officers saw the BMW 1 series with two occupants driving in Nottingham Road, Basford, on to Sherwood Rise at 2.49am. The officers attempted to stop the vehicle in Magdala Road but Brown failed to stop, instead continuing to drive on to Lucknow Avenue. He began to speed down the hill and over speed bumps, where officers believe he lost control of the vehicle and crashed.

When officers approached the vehicle Brown was seen climbing through to the rear seat area from the front driver’s side seat and exiting the vehicle, followed by the passenger.

Brown was detained and a roadside breath test was conducted, where he blew over the limit and was arrested. In custody, Brown denied he was driving and tried to claim there was a third passenger in the vehicle, as he was aware he was already disqualified from driving.

However, Brown was charged with dangerous driving, driving while disqualified and driving over the prescribed limit for alcohol. The passenger, who was the owner of the car, was also arrested at the scene and later released with no further action.

Brown was found guilty of the offences at Nottingham Crown Court on May 13 2020 and sentenced to 15 months in prison, suspended for two years, banned from driving for three years and he will have to take an extended test when he is eligible.

Brown was also ordered to pay costs of £300 and a victim surcharge of £140.

Shemane Marsh, Nottinghamshire Police said: “We are pleased with the court result and it was very fortunate that no one was serious injured due to Brown’s actions.”
