Dispose plea seeking survey of Krishna Janmabhoomi Shahi Idgah within 4 months: Allahabad HC to Mathura court

PRAYAGRAJ: The Allahabad high court on Monday directed the civil court at Mathura to pass an order, within four months, on an application pending before it for conducting a survey of Shri Krishna Janmabhoomi and Shahi Idgah by the Archaeological Survey of India (ASI).

Disposing a petition filed by Bhagwan Shri Krishna Virajman through his devotee Manish Yadav, Justice Piyush Agrawal further directed the Mathura court to decide the aforesaid application after giving an opportunity of hearing to the parties concerned and without granting unnecessary adjournments to either of the parties, if there is no legal impediment.

The petitioner had sought a direction to the civil judge (senior division), Mathura, to decide the application dated May 13, 2022, pending in original suit No. 152 of 2021 (Shri Krishna Virajman and others Vs UP Sunni Central Waqf Board and others), within a stipulated period of time.

It was contended by the counsel for the petitioner that since the application was pending for consideration, the petitioners were suffering irreparable loss.

Passing these directives, the court observed, “Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the concerned court below to consider and decide the application dated May 13, 2022, under Section 26 of the Criminal Procedure Code (CPC) pending in the aforesaid case in accordance with law expeditiously and preferably within a period of four months from the date of receipt of certified copy of this order, but certainly after giving an opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, if there is no legal impediment.”

The present petition was filed in the high court seeking expeditious disposal of an application filed before the Mathura court in which a request was made to conduct an archaeological survey of the Mathura’s Shri Krishna Janmabhoomi and Shahi Idgah.

It was claimed in the application pending at the court in Mathura that the disputed complex was earlier a temple. The Shahi Idgah mosque was built after demolishing the temple. As per the application, Kansa had imprisoned the parents of Shri Krishna in the Dwapar era at a place, where there is a mosque now. According to the applicant, it is the birth place of Lord Shri Krishna.
