Dave Mahon set to face criminal trial over alleged assault of pensioner

Dave Mahon is set to face a criminal trial over the alleged assault of a pensioner.

Mr Mahon, 51, appeared before a brief sitting of Carrick-On-Shannon’s District Court on Tuesday morning, accompanied by his wife Audrey.

During the proceedings, Tony Collier, acting for Mahon, asked for the court to amend his client’s bail conditions as he has recently secured a job that may require night shifts.

Mr Mahon had been on bail and under a strict curfew of remaining at his home between 10pm and 8am.

Judge Deirdre Gearty amended the curfew to 12am to 4am to facilitate Mr Mahon’s night shifts.

She also allowed for a condition in which Mr Mahon can inform gardai that he intends to travel for a medical appointment and possible overnight stray.

She also granted for Mr Mahon to be able to visit his elderly father in Dublin so long as he notifies gardai.

Mr Mahon is charged with assaulting a 70 year old man at an address in Breffni Crescent, Carrick On Shannon on the evening of Thursday, August 26.

He has not indicated how he will plea to the charge.

On Tuesday the court heard that the accused is to be brought forward to the local circuit for a trial on indictment.

Judge Gearty then adjourned the matter to October 22 when the book of evidence is due to be brought before the court.

Legal aid was also granted to Mr Mahon who is being represented by Tony Collier of Ferrys Solicitors.

Mr Mahon is the stepfather of Amy Fitzpatrick, a 15-year-old Irish teen who vanished from the Mijas Costa area of Spain on New Year's Day 2008.

He is married to Amy’s mother Audrey, who appeared in court today to support her husband.
