Darwin man found guilty of beer bottle rape of buck's party performer

Kevin Willcocks was found guilty of rape in the NT Supreme Court.

A Darwin man who inserted his beer bottle into the vagina of a woman who was performing a buck's night sex show has been found guilty of rape.

The jury delivered a majority verdict after failing to reach a unanimous decision after about a day's deliberation.

Kevin Willcocks, 41, closed his eyes in the dock when the verdict was read out.

He was remanded in custody. Sentencing submissions will take place on Friday.

Willcocks had not denied inserting his beer bottle into the woman's vagina while she performed a dildo show she had been contracted to perform at a buck's night in the Darwin rural area in 2017.

He pleaded not guilty to the charge of sexual intercourse without consent, denying that he had acted with knowledge or being reckless about a lack of consent from the woman.

After the verdict, the prosecutor told the court a term of imprisonment was "the normal course" for the offence.

The defence lawyer argued for permission to apply for bail, saying that the circumstances of the case were "very unusual".

The defence had argued that the context of the occasion — the location, the amount of alcohol involved and the work of the woman involved — was central to the question of whether Willcocks had been reckless about consent.

The bail request was denied by Justice Dean Mildren, who noted that a mandatory minimum sentencing applied.

Case 'highlights what is consent'

The guilty verdict was welcomed by Leanne Melling, a spokeswoman for the Sex Workers Outreach Program from the Northern Territory Aids and Hepatitis Council.

"I think what it really says is that anybody who works in the sex industry can come forward and report crimes against them," she said.

"This case really highlights the distinction between what's work and what's not.

"And it also importantly highlights what is consent and what's not — in personal circumstances and in workplace circumstances."
